FIREARMS TRAINING AND RELEASE AGREEMENT

Release, Waiver, Indemnification, Hold Harmless, Assumption of Risk

Whereas, in consideration of being permitted to attend a course for instruction in firearms by Praetor Firearms Training, L.L.C, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Student signing this document (hereafter “Student”) agrees to the following:

1. I am aware and understand that firearms instruction activities are inherently dangerous and involve the risk of serious injury, death, and/or property damage. I acknowledge that any related injuries that I could sustain may be compounded by any negligent emergency response or rescue operations by praetor for the Student. I acknowledge that I am voluntarily participating in these instruction activities with knowledge of the risk and danger involved and agree to accept and assume any and all risks of injury, death, property damage, whether caused by the Student, Instructor or otherwise.

2. Student agrees to indemnify, hold harmless and defend Praetor Firearms Training, L.L.C (including Robert F. Phillips), all agents, employees, heirs, successors, assigns, and/or assistants (also herein referred to collectively or individually as “Instructor” and/or Releases), from any and all fault, liabilities, costs, damages, expenses, claims, demands, or lawsuits arising out of, related to, or connected with: Student’s presence at and participation in the course of firearms instruction; Student’s use of such instruction in the future; the discharge of firearms by the Student, Student’s presence on and/or use of the range, building, land, and premises (“Premises”); and, any and all acts or omissions of Student or anyone else at the Premises.

3. Student waives for Student and for Student’s agents, executors, personal representatives, administrators, assignees, successors, heirs and next of kin, any and all rights, liability, and claims for any and all damages, losses, demands and any other actions or claims whatsoever, known or unknown, which Student may have or which may arise against Instructor including but not limited to the death of Student and/or any and all injuries, damages or illnesses suffered by Student and/or Student’s agents, heirs, assigns and/or or Student’s property, which may, in any way arise out of, be related to or connected with: the instruction and course of Instruction, the Premises, including any latent defect in any firearms or other instruction-related equipment, the Premises; Student’s presence on or use of said Premises; Student’s property (whether or not entrusted to Instructor); and the use of ammunition and discharge of firearms. Instructor shall not be liable for any claim, liability and/or injury noted herein, and the Student, on behalf of himself/herself and on behalf of his/her executors, personal representatives, administrators, assignees, heirs, and next of kin, hereby expressly release the Instructor from any and all such claims and liabilities.

4. Student affirmatively covenants not to make or bring any claim referenced in this Agreement, known or unknown, against Instructor or any other Releasee, and forever releases and discharges Instructor and Releases from liability under such claims.

5. Student further irrevocably waives waives, to the fullest extent permitted by applicable law, any right to a jury trial in connection with any possible claim arising out of Student’s participation in firearms training instruction activities.

6. Student expressly assumes the risk of participating in the course for instruction in firearms and any activities on the Premises, including, but not limited to, instruction in the use of firearms, the discharge of firearms and the firing of live ammunition.

7. Student hereby acknowledges and agrees that Student has read this instrument and understands it terms and is executing this instrument voluntarily.

8. Student furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all range rules and procedures and any other rules and procedures stated by the Instructor.

9. Student expressly agrees that the release and waiver of rights by Student in this instrument are intended to be as broad and inclusive as permitted by law and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.

10.This Agreement binds Student and also binds Student’s agents, executors, personal representatives, administrators, assignees, heirs and next of kin.

11.Student agrees to follow the written safety rules attached to this agreement and any and all other safety rules and instruction provided by Instructor, written or otherwise.

12.Student affirmatively represents there are no legal or physical restrictions impacting Student’s ability to possess, handle and/or use firearms and participate in firearms and/or personal protection training. Student certifies that Student is a U.S. citizen.

13. Student declares under penalty of perjury that Student is not a person prohibited under federal, state or tribal law from possessing a firearms. Student declares under penalty of perjury that Student is not facing criminal charges in any jurisdiction that prohibits access to and/or possession of a firearms under federal, state or tribal law.

14. This Agreement constitutes the sole and entire agreement of the Student and Instructor and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether oral or written.

FIREARMS TRAINING AGREEMENT SAFETY RULES

Please read the following firearms safety rules and initial your agreement to follow and abide by such rules.

Safety Rules

1. Treat every gun as if it were loaded.

2. Never point a gun at a person on the Premises.

3. Never point a gun at anything you are not willing to kill or destroy.

4. Always keep your gun pointed in a safe direction (downrange).

5. Keep your finger off the trigger until your front sight is on the target.

6. Know what is at your target, around your target, and beyond your target.

7. Know how to operate your gun.

8. Always know the status of your gun.

9. We will operate under a COLD RANGE (a "cold range" is where all guns must remain unloaded and holstered until instructed at the firing line.) (No touching guns until at the line and instructed to load/unload. Loading/unloading only occurs at the line on your command.)
